3. User Accounts

Payments are processed through Stripe. You agree to:

• Provide valid payment information
• Pay all applicable fees and taxes
• Accept that all sales are final
• Comply with Stripe's Terms of Service

4.3 Refunds

Credit purchases are generally non-refundable. Refunds may be issued at our sole discretion for:

• Technical errors or service outages
• Duplicate charges
• Unused credits within 7 days of purchase (case-by-case basis)

5. Acceptable Use Policy

You agree NOT to use the Service to create or request:

• Illegal, harmful, or offensive content
• Content that infringes intellectual property rights
• Child sexual abuse material (CSAM)
• Non-consensual intimate imagery
• Content that promotes violence, hate, or discrimination
• Misleading or fraudulent content (deepfakes without disclosure)
• Spam or automated abuse
• Content that violates any applicable laws

Violation of this policy may result in immediate account termination without refund.

6. Intellectual Property Rights

6.1 Generated Images

You retain ownership of images you generate through our Service, subject to these Terms and applicable laws. However:

• Images are generated using Google's Gemini AI technology
• You are responsible for ensuring your use complies with applicable laws
• You grant us a limited license to store and display your images for service provision
• AI-generated content may have limitations on commercial use depending on jurisdiction

6.2 Our Service

All rights in the Service, including software, design, and branding, belong to BrixlAI. You may not:

• Copy, modify, or reverse engineer our Service
• Remove any proprietary notices
• Use our branding without permission

7. Service Availability and Limitations

We strive for high availability but do not guarantee uninterrupted service. We may:

9. Indemnification

You agree to indemnify and hold harmless BrixlAI from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of generated images
• Your violation of any third-party rights
• Your violation of applicable laws

10. Termination

10.1 By You

You may delete your account at any time from your Account Settings. Upon deletion:

• All your data will be permanently deleted
• Unused credits will be forfeited
• This action cannot be undone

10.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service
• Create content that violates our policies

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
